Being charged with the crime of Criminal Nonsupport can be confusing.
First, you believe that you are innocent of this Criminal Nonsupport Charge since you have provided "support" for your child or children. Maybe you paid the custodial parent directly, and/or you bought food, clothing or medicine for your child(ren).
Second, you also believe that you are innocent of this charge on Criminal Nonsupport because you have a "valid reason", which is a "good cause" defense, as to why you were not been able to make the required child support payments.
Maybe you had lost your job and you were not able to make the child support payments for a period in time because you were not being paid.
Maybe you are now working or back to work and the State is taking money out of your paycheck for this child support.
Maybe you had been locked up or incarcerated for a period of time and were just released not that long ago.
Are these some of the reasons you feel it is not right that you are being charged with the crime of Criminal Nonsupport?
You may ask so how can the State charge a person with this crime of Criminal Nonsupport?
The fact is that as long as the State can show by their records that you owe more than the total amount of 12 months worth of back child support, the State has grounds to file a Felony Charge of Criminal Nonsupport against you. So for example, if you owe $100.00 per month for child support, and the total amount of back child support you owe is over the sum of $1,200.00, the State has grounds to file a Felony Charge against you. If the total amount of back child support owed it is less than $1,200.00, then the State only has grounds to file a Misdemeanor Charge or Criminal Nonsupport against you.
But, the State still has to be able to PROVE that you are guilty of this Criminal Nonsupport Charge.
That is why you need a Criminal Nonsupport Defense Lawyer - a Criminal Nonsupport Defense Attorney - to represent you and to defend you so that you can be found NOT GUILTY of this charge of Criminal Nonsupport.

When you are finally released from custody, you will be just that much further behind in your child support payments. You will end up owing more money for child support than when this criminal case started!
